Labour Market Opinion (LMO)

Most employers need a positive Labour Market Opinion (LMO) before being able to hire a foreign worker. After the employer receives their positive Labour Market Opinion (LMO), the foreign worker can then apply for their work permit. Most foreign workers will not be able to apply for a work permit without a positive Labour Market Opinion (LMO), although there are some exceptions.

Service Canada has criteria that they use when assessing a Labour Market Opinion (LMO) Application. Some of the things that they consider are the following:
• What is the foreign worker’s occupation listed on the Labour Market Opinion (LMO) Application;

• What are the wages being offered to the foreign worker on the Labour Market Opinion (LMO) Application;
• Whether the labour market will benefit from the arrival of the foreign worker;
• Whether the working conditions and wages listed on the Labour Market Opinion (LMO) Application are what they should be for the province and region;

One of most common reasons for the denial of a Labour Market Opinion (LMO) Application is the lack of proof that the employer has tried to recruit locally. Service Canada requires a minimum of 14 calendar days of advertising within the three months prior to submitting the Labour Market Opinion (LMO) Application. Advertising should be done in national newspapers, Canada Job Bank, recognized internet job sites, journals, etc.

After the employer receives the positive Labour Market Opinion (LMO), the worker will need to submit their work permit application to the Canadian Consulate that services their area. Many countries have consulate offices that will receive the work permit applications, but then the work permit applications are sent on to an embassy or consulate in a different country. For example, all work permit applications received in Ecuador are then sent on to Bogota, Columbia to be processed.

The foreign worker must be eligible for the job that the employer is offering in order to apply for their work permit. A positive Labour Market Opinion (LMO) just means that an employer may hire a foreign worker; it does not mean that the foreign worker’s work permit application will be approved. Being approved for a work permit does not give the worker the right to stay in Canada. The work permit only allows a foreign worker to work in Canada for a determined amount of time directly stated on the foreign worker’s work permit.
